Lidl can have injunction to stop Tesco copying logo

London’s High Court has ruled that Lidl can have an injunction to stop Tesco copying its logo.

However, this would cost Tesco almost £8m to remove all Clubcard loyalty scheme logos, Reuters reported.

In April, Tesco lost a trademark lawsuit against Lidl over the use of a yellow and blue logo as the High Court found it takes “unfair advantage” of Lidl’s trademark logo.

Lidl since requested an injunction, which Tesco’s lawyers said was an unncessary move, instead arguing the leading retailer could pay a small amount of damages.

However, Judge Joanna Smith ruled on Wednesday (21 June) that Lidl could have an injunction and said “the only certain way to put an end to the loss that Lidl is incurring by reason of the continuing use of the (Clubcard) signs is to grant a final injunction”.

Although, this will not be put into place until all appeals have been made and resolved.

If Tesco is unsuccessful on appeal, it will have nine weeks to remove Clubcard logos when proceedings come to a close.
