M&S hit with class action lawsuit over cyber attack

Marks and Spencer (M&S) is facing a potential multi-million-pound class action lawsuit following a recent cyber attack that saw customer data stolen.

The retailer confirmed last week that hackers accessed personal shopper information, including dates of birth, contact details and online order history. However, while M&S has stated that no payment data or passwords were taken, it has been confirmed legal action is already underway.

Thompsons Solicitors is leading a group claim on behalf of affected customers, accusing the retailer of failing to adequately protect personal data. The firm said it had been “inundated” with complaints following the breach.

Senior partner Patrick McGuire told The Sunday Mail: “This could be the biggest data theft case we have ever been involved in.”

The fallout has also hit the top of the business. CEO Stuart Machin is expected to lose over £1.1m in bonus and performance-related pay after the company’s share price dropped 14% in the wake of the breach.

M&S has not commented further on the legal action but continues to reassure customers that the stolen data has not been shared or used maliciously.

    Yes , since the attack the weather has been dreadful AND my back hasn’t stopped aching . What about some compensation!

    What gesture does M+S intend on making to staff..Not only has their data also been leaked, they have had to use their personal devices to keep the company afloat, dealt with customer frustrations and other emotive issues.

    That’s not correct. After M&S hack I have started receiving lots of spam mail on my G mail account before that I did not received any spam mail

      This is happening to me too! On one day it was 64 emails, which is not good.

    Mine is my mobile phone. I’ve had several text messages with dodgy links every day since the hack. Never had any before

    I have been receiving emails averaging two a day from what I believe are spam using M&S headings.

    I seem to be getting a lot more spam calls/emails since the hack. M&S say no data has been sold on, how do they know? I feel sorry for them, but like most companies they do the bare minimum to prevent cyber attacks because of cost, how much has it cost now?

    The customers should be gathering a law suit against the IT provider marks and Spencer outsourced to, and that is the Indian company TCS.
